How We Approach Litigation

Neal & Leroy’s litigation practice is built on preparation. Our attorneys understand the factual record before a motion gets filed or an argument gets made, and that groundwork is what shows up in the courtroom. The firm has tried hundreds of jury and bench trials and has appeared regularly before the Circuit Court of Cook County, the U.S. District Court for the Northern District of Illinois, and the Illinois appellate courts.

That preparation extends beyond courtroom strategy to the day-to-day management of each matter. Our attorneys hold weekly meetings with clients and outside consultants and track the progress of every open matter, so nothing gets lost or missed. While most of our cases resolve before trial, we prepare every matter as though it will be tried. Eminent Domain

  • Represented public university in acquisition of 100+ properties for major campus expansion project; structured TIF financing for the development; defended university in Federal court against alleged violation of National Historic Preservation Act.

  • Called as expert witness in trial concerning eminent domain procedures exercised by public body.

  • Represented public building agency in a jury trial to acquire the site for teachers’ academy school.

EMPLOYMENT LAW

  • Neal & Leroy has successfully represented Exelon in litigating more than 50 charges of employment discrimination at IDHR, EEOC, City of Chicago, and the County of Cook. Neal & Leroy has successfully represented Exelon in litigating more than 50 charges of employment discrimination at IDHR, EEOC, City of Chicago, and the County of Cook. Also, the firm represented Exelon in litigation in connection with a claim of termination based on race, combined breach of contract/unfair labor practice, failure to provide extended pension benefits, and a state tort allegation of wrongful discharge.

GENERAL COUNSEL LITIGATION

  • Neal & Leroy has represented the Public Building Commission of Chicago for over 50 years as its general counsel in litigation. GOVERNMENT & MUNICIPAL LAW

  • Represents major retail mall owner in circuit court litigation against the State involving the extent of the State’s constitutional powers of contract.

GOVERNMENT AGENCIES

  • Represented the Illinois International Port District in claims litigation arising from the construction of the Harborside International Golf Center.

  • Served as counsel for the University of Illinois in federal court and before a state agency. Served as counsel for the University of Illinois in federal court and before a state agency in connection with the University’s $550 million South Campus Development Project. Also represented the University in historic preservation litigation involving the Maxwell Street Market.

Interstate Commerce Commission Termination Act (ICCTA)

  • Represented municipal transit agency in Federal District Court and Seventh Circuit Court of Appeals in proceedings where railroad questioned the municipality’s authority to acquire railroad property subject to the Interstate Commerce Commission Termination Act.

  • Represents clients on a variety of commercial litigation matters.

  • Represented creditors in post judgment collection matters.

REAL ESTATE LITIGATION

  • Represented clients in post real estate closing lawsuits, homeowner association conflicts, and municipal code violation matters.

  • Counsel for large casino operator in connection with successful defense of citation under the Illinois Smoke Free Act.

ZONING & LAND USE

  • Defended non-profit community medical services agency against injunction and damage claim brought by neighboring property owner claiming zoning and restrictive covenant violations.
